Effective date: October 3, 2026
These Terms of Use (“Terms”) govern your access to and use of https://adamsemotionalagilitycoaching.com
and its content, forms, digital products, and related services
(collectively, the “Website”). The Website is operated by Adams
Emotional Agility Coaching (“AEAC,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms and our
Privacy Policy. If you do not agree, do not use the Website.
1. Purpose of the Website
The Website provides information about emotional agility, personal
growth, coaching, speaking, writing, the STAY Framework, The Chapter
We’re In podcast, and related educational products and services.
Website content is provided for general education, personal growth,
and informational purposes. It is not individualized professional
advice.
2. Eligibility
You must be at least 18 years old and legally able to enter into an
agreement to purchase a product, submit a coaching inquiry, or use paid
services through the Website. If you use the Website on behalf of an
organization, you represent that you are authorized to act for that
organization.
3. Coaching and
Educational Disclaimer
Adams Emotional Agility Coaching provides coaching, education,
reflection tools, and personal-development resources. These services are
not psychotherapy, counseling, medical care, psychiatric care,
diagnosis, crisis intervention, legal advice, financial advice, or a
substitute for services from a licensed professional.
Viewing the Website, downloading a resource, joining an email list,
or submitting an inquiry does not create a coach-client relationship. A
coaching relationship begins only when the parties enter a separate
written coaching agreement.
You are responsible for your own decisions, actions, wellbeing, and
results. If you are experiencing a medical or mental-health emergency,
contact emergency services or an appropriate qualified professional. In
the United States, you may call or text 988 for the Suicide and Crisis
Lifeline.
4. No Guarantee of Results
Personal growth, coaching, leadership, and emotional-agility outcomes
vary by person and circumstance. We do not guarantee any particular
personal, professional, financial, relational, health, or emotional
outcome.
Testimonials and examples describe individual experiences. They are
not promises, guarantees, or representations that every person will have
the same experience.
5. Intellectual Property
Unless otherwise stated, the Website and its original content are
owned by or licensed to Adams Emotional Agility Coaching and are
protected by intellectual-property laws.
This includes, without limitation:
- The STAY Framework and its original teaching language.
- Digital workbooks, exercises, prompts, worksheets, graphics, and
downloads. - Website copy, articles, audio, video, podcast-related materials, and
visual branding. - Course, coaching, speaking, and program materials.
You may view Website content for personal, noncommercial use. You may
not reproduce, republish, upload, distribute, sell, sublicense, modify,
create derivative works from, teach from, or commercially exploit
protected content without prior written permission.
Purchase of a digital product grants only the limited license
described in Section 7. No ownership or intellectual-property rights are
transferred to you.
6. Acceptable Use
You agree not to:
- Use the Website for unlawful, fraudulent, abusive, or harmful
activity. - Attempt to gain unauthorized access to the Website, accounts,
checkout, files, or systems. - Interfere with Website operation, security, or availability.
- Introduce malicious code, scrape the Website at an unreasonable
rate, or use automated systems to copy protected content. - Impersonate another person or submit false or misleading
information. - Use our content to train, populate, or improve a commercial product,
artificial-intelligence system, content library, course, certification,
or competing service without written permission. - Remove copyright, ownership, or attribution notices.
- Share paid downloads with people who did not purchase them.
We may restrict access when we reasonably believe these Terms have
been violated.
7. Digital Product License
When you purchase a digital product, we grant you a limited,
revocable, nonexclusive, nontransferable license to download and use the
product for your own personal, noncommercial use.
Unless a product page or written license expressly says otherwise,
you may not:
- Share the file or download link with another person.
- Upload the product to a shared drive, membership site, social
platform, or public website. - Resell, redistribute, sublicense, or give away the product.
- Copy substantial portions into another workbook, program, training,
or publication. - Use the product to provide services to clients, students, employees,
or groups. - Remove branding, copyright notices, or identifying information.
Separate written permission or a commercial license is required for
professional, organizational, classroom, group, or client use.
8. Purchases and Payment
Prices are shown in United States dollars unless stated otherwise.
You agree to provide current and accurate purchase information and
authorize our payment processor to charge the payment method you
provide.
Payment processing is provided by third parties such as Stripe. Their
terms and privacy practices also apply to the payment transaction.
We may correct pricing or product-description errors, decline or
cancel a transaction affected by an obvious error, or limit availability
when reasonably necessary. If we cancel a completed purchase for one of
these reasons, we will issue any refund required by law.
Digital-product delivery, technical support, and refund eligibility
are governed by our Digital Product Refund and Delivery Policy, which is
incorporated into these Terms.
9. Coaching, Speaking,
and Other Services
Submitting a form does not guarantee acceptance, availability, or a
particular service. Coaching, speaking, workshops, and other
professional services may require a separate written agreement
describing scope, fees, scheduling, cancellations, confidentiality, and
other terms.
If a separate signed agreement conflicts with these Website Terms
regarding a paid professional service, the separate signed agreement
controls for that service.
10. Email and Communications
When you submit an inquiry or complete a purchase, you authorize us
to send messages reasonably necessary to respond, deliver the product or
service, provide support, and administer the transaction.
Promotional email will be sent in accordance with your choices and
applicable law. You may unsubscribe from promotional email using the
link provided in the message. Unsubscribing from promotional email does
not prevent necessary transactional or service communications.
11. User Submissions and
Feedback
You retain ownership of original content you submit through an
inquiry, message, or feedback form. You grant us permission to use that
content only as reasonably necessary to respond, provide the requested
service, maintain records, protect the Website, or comply with law.
We will not publicly use your name, testimonial, likeness, or private
story for marketing without permission. If you separately authorize a
testimonial, the scope of that authorization will control.
Do not submit content that is unlawful, infringing, threatening,
defamatory, deceptive, or that violates another person’s privacy or
rights.
12. Third-Party Links and
Services
The Website may link to third-party websites and platforms, including
payment, scheduling, email, podcast, video, social-media, and other
services. We do not control those services and are not responsible for
their content, security, availability, policies, or practices.
A link does not necessarily mean we endorse every statement, product,
or service offered by the third party. Your use of third-party services
is governed by their terms and policies.
13. Website Availability
and Changes
We may update, suspend, remove, or discontinue Website content,
products, or features at any time. We do not guarantee that the Website
will always be uninterrupted, current, secure, or free from errors.
We may correct errors and update content without prior notice.
Product changes will not reduce rights that applicable law gives to a
completed purchase.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content
are provided “as is” and “as available” without warranties of any kind,
whether express or implied.
We do not warrant that the Website or any content will meet every
user’s needs, produce a particular result, remain uninterrupted, or be
free from errors, viruses, or harmful components. Nothing in these Terms
excludes a warranty or consumer right that cannot legally be
excluded.
15. Limitation of Liability
To the fullest extent permitted by law, Adams Emotional Agility
Coaching and its owner, contractors, and service providers will not be
liable for indirect, incidental, special, consequential, exemplary, or
punitive damages arising from or related to Website use, inability to
use the Website, reliance on Website content, or use of third-party
services.
To the fullest extent permitted by law, our total liability for a
claim relating to a purchased digital product will not exceed the amount
you paid for that product. This limitation does not apply where
prohibited by law or to liability that cannot legally be limited.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold
harmless Adams Emotional Agility Coaching and its owner and contractors
from third-party claims, losses, liabilities, and reasonable expenses
arising from your unlawful use of the Website, violation of these Terms,
infringement of another person’s rights, or unauthorized distribution or
commercial use of our content.
This section does not require you to indemnify any person for conduct
for which indemnification cannot legally be required.
17. Governing Law
These Terms are governed by the laws of the State of California,
without regard to conflict-of-law principles. Any dispute not resolved
informally will be brought in a court with lawful jurisdiction in
California, unless applicable consumer law requires another
location.
Nothing in these Terms limits a consumer right or remedy that cannot
be waived under applicable law.
18. Changes to These Terms
We may revise these Terms to reflect changes in the Website,
products, services, or law. The revised Terms will be posted with an
updated effective date. Changes apply prospectively unless applicable
law permits otherwise.
Your continued use of the Website after revised Terms become
effective constitutes acceptance of the revised Terms.
19. Severability and No
Waiver
If any provision of these Terms is found unenforceable, the remaining
provisions will remain in effect, and the affected provision will be
interpreted as closely as legally permitted to its original purpose.
Failure to enforce a provision does not waive the right to enforce it
later.
